Immigrant investor program

The EB-5 Immigrant Investor Program offers foreign individuals a pathway to lawful permanent residency by investing in U.S. businesses and creating U.S. jobs. The EB-5 Program is administered by United States Citizenship and Immigration Services (USCIS).

What must an EB-5 investor do to Meet the visa Requirements?

To meet the visa requirements from the EB-5 Immigrant Investor Program, the foreign investor must make an at-risk investment in a U.S. project that creates at least 10 new U.S. jobs.

EB-5 projects create direct and indirect jobs by spending dollars and generating revenue. Economists like Vermilion Consulting use mathematical models to determine a project’s job creation.

Direct jobs are created within the primary industry where the money is spent.  Indirect jobs are created in other industries that support the primary industry.

An EB-5 investor can either invest in a Project directly or invest with a group of other foreign investors through a designated Regional Center.

What is a regional center?

An organization designated by USCIS that brings together EB-5 investors and U.S. projects in need of capital.

What is the investment threshold to meet the visa requirements?

For projects inside a Targeted Employment Area (TEA): $800,000. For projects outside of a TEA: $1,050,000.  The investment puts the individual on a pathway to obtaining a green card if certain job-creation conditions are met.

What exactly is a targeted employment area (TEA)?

A TEA is a geographical area that meets either the Rural or High Unemployment criteria. A Project within a TEA receives certain preferences in the EB-5 program.
